Copyright and License Terms for TMF Products

The results arising from the TMF’s project and other activities are diverse and extensive. Working materials, software tools, informative and scientific publications, and, not least, service offerings are made available to networked medical research. The need for clear regulations regarding their use (including further processing and distribution) has been repeatedly expressed by users of these results and also stems from the TMF’s obligation to ensure quality, up-to-dateness, and dissemination.

Product Types

The terms of use and related processes differ in form and content depending on the product type. The TMF currently distinguishes between the following fundamental product types:

1. Volume of the TMF Publication Series
2. Report or Expert Opinion (e.g., TAB reports or expert opinions on sponsor responsibilities)
3. Working Material (e.g., sample contracts, sample SOPs, training materials, etc.)
4. Software
5. Source Code of Software
6. Consulting Services
7. IT Infrastructure

Which project results are to be classified as products and to which product type they belong is determined separately for each project and on a case-by-case basis.

This work was designed as working material, which means that modifications to printed copies and renamed versions of the original file are permitted, provided that they are clearly marked to avoid confusion with the original document. The terms of use and the TMF logo may be removed from the modified copies. The TMF recommends always keeping the printed original document or the write-protected original file as a reference. Duplication and distribution of modified versions are also only permitted within your organization or company and within the TMF membership, unless otherwise agreed with the TMF.

If modified copies or documents created using this work are used in practice, they should be sent by email to the TMF office (info@tmf-ev.de), unless legal or contractual obligations (including toward third parties) prevent this. These submitted documents will be used by the TMF exclusively for the purpose of further development and improvement of the TMF’s outputs and will not be published.

Duplication and distribution of modified source code is also permitted exclusively within your organization or company as well as within the TMF membership, unless a different agreement with the TMF exists.

In doing so, the copyright notices in the code referring to the TMF must be retained, and the text file with the TMF’s usage terms must be included.

The terms of use for consulting services are agreed upon individually.

The terms of use for IT infrastructure offerings (services) vary and can be found in the product description or obtained from the TMF’s office.
