Data Protection Framework for Medical Research

This legal opinion provides a comprehensive description of the data protection framework for medical research and answers the specific questions from the research community collected by the Data Protection Workgroup. In a concluding chapter, the expert assesses the new regulations. He considers how practicable the regulations are and to what extent they enable medical research projects and the implementation of privacy protection.

The University Medicine Greifswald commissioned this legal report that DIERKS+COMPANY prepared. Two real-world research projects, the Baltic Fracture Competence Centre (BFCC) as well as the German Centre for Cardiovascular Research (DZHK) provide use cases, questions, and context for this legal report. It addresses questions regarding all steps of data processing. The report provides practical answers to a wide array of technical and organizational questions in data protection-compliant processing of research data.

The results generated within the scope of the TMF’s project and other activities are diverse and extensive. Working materials, software tools, informative and scientific publications, and, not least, service offerings are made available to the networked medical research community. The need for clear regulations regarding their use (including further processing and distribution) has been expressed repeatedly by users of these results. It also arises from the TMF’s obligation to ensure the quality, timeliness, and dissemination of these resources.
