Ethics and Data Protection

In nationwide collaborative medical research, a coherent data protection concept is often a challenge: Researchers are usually faced with the question of how data and samples can be analyzed across countries in compliance with data protection regulations, which legal framework is relevant, and how to comply with the demands and expectations of various data protection supervisory authorities. The TMF has been committed to ethics and data protection in medical research for over 20 years.

Many collaborative research projects have successfully developed their data protection concept with the support of the TMF.

Research consortia and institutions are supported in the development of data protection concepts; expert opinions are prepared and guidelines for researchers are developed. The basis for the consultation is the set of generic solution approaches for data protection concepts developed by the Data Protection Working Group, which were most recently recommended by the Data Protection Conference for use in medical research. Concrete solutions can be derived from these concepts and implemented in individual projects and infrastructures.

Introduction of the Workgroup

The task of the Data Protection Workgroup is to advise research networks and projects on data protection matters, particularly on creating data protection concepts. The basis for this is the generic solutions for data protection concepts developed by the workgroup, which are coordinated with the data protection officers of the federal and state governments.

TMF Publication Series: Data Protection Framework for Medical Research

This legal report comprehensively describes the data protection framework for medical research and answers the specific questions from the research sector collected by the Data Protection Working Group. In a concluding chapter, the expert assesses the new regulations. In doing so, he discusses how practicable the regulations are and to what extent they enable medical research projects and the execution of privacy protection.

The TMF is a coordinating body for strategically relevant collaborative research projects at national and international levels. It is also involved in many small and large research projects as a specialized partner with a high level of expertise, particularly in legal, data protection, and ethical issues. In addition, it is involved in the development of concepts and project ideas for ministries and scientific institutions - regionally, nationally, and internationally.

HealthyCloud wird eine strategische Agenda und eine Roadmap für das European-Health-Research-and-Innovation-Cloud(HRIC)-Ökosystem vorlegen. Hierfür wird ein konsolidiertes Stakeholder-Feedback eingeholt – der Europäischen Kommission, der Mitgliedsstaaten sowie regionaler, nationaler, europäischer und internationaler einschlägiger Initiativen.

Ziel des Projekts „Routine Anonymized Data for Advanced Service Research – RADARplus“ ist die Erhaltung und Weiterführung des Betriebes der RADAR-Infrastruktur, in der Behandlungs­daten von Patientinnen und Patienten aus der hausärztlichen Versorgung in eine Forschungs­datenbank überführt und für die Versorgungs­forschung in zwei Szenarien genutzt werden: die Verarbeitung anonymisierter (Szenario 1) und pseudonymisierter (Szenario 2) Behandlungsdaten.

Ziel dieses Innovationsfonds-Projektes ist die sektorenübergreifende Charakterisierung der Inanspruchnahme ambulanter Versorgungs­strukturen vor und nach einer Notaufnahme­behandlung und die Identifikation von Versorgungsmustern als Basis für die Entwicklung von Interventionen zur bedarfsgerechten Anpassung der Versorgungs­strukturen. Die TMF hat in Zusammenarbeit mit den Projektpartnern ein umfangreiches Datenschutzkonzept erstellt und war federführend bei der Abstimmung mit den zuständigen Aufsichtsbehörden. Da 16 Notaufnahmen aus acht Bundesländern teilnehmen, waren die spezifischen rechtlichen Rahmenbedingungen zu eruieren und umzusetzen.
