Medical research is increasingly referring to data from healthcare. Systematic analysis of this data is a promising method that is also important for quality assurance in the healthcare sector. However, this 'secondary use' of treatment data comes with numerous legal issues. Social and health data is some of the most intimate information about a person and, therefore, requires a particularly high level of protection. Therefore, the opportunities and risks must be carefully considered, given the right to informational self-determination. This legal report is the first detailed overview of the specific legal framework for the secondary use of medical data in the individual federal states, which also takes into account the different sponsorship and legal forms of the treating institution. The analysis provides researchers and other stakeholders in the healthcare sector with guidance on the legally compliant handling of medical treatment data. The book also contains a supplementary expert opinion that presents the legal framework for the secondary use of data managed via the electronic health card under § 291a SGB V.
